OFFICIAL RULES

This contest is sponsored by The Hype Hustle LLC (“Hype Hustle” and/or “Sponsor”) located at PO Box 325, Sierra Madre, CA, 91025.  The Hype Hustle Contest for Musicians (“Contest”) is operated through the Hype Hustle Contest Web Site located currently located at http://www.hypehustle.com  (“Website”). BY ENTERING OR OTHERWISE PARTICIPATING IN THE CONTEST, ALL ENRANTS AND OTHER PARTICIPANTS AGREE TO ABIDE BY THESE OFFICIAL RULES, WHICH ARE FINAL AND BINDING ON ALL MATTERS PERTAINING TO THIS CONTEST.

Eligibility: This contest is FREE to enter.  VOID WHERE RESTRICTED OR PROHIBITED BY LAW. The Contest is open to individuals from all countries and territories worldwide who are applicants to www.hypehustle.com (“Entrant”) and at least 13 years of age at time of entry. Applications are available for free by emailing info@hypehustle.com.  The application will be delivered to the applicant via email. The application will be provided at NO COST. During the Hypehustle.com registration process, Entrant will be asked to provide his or her name, physical address, email address, telephone number, birth date, and links to various social media profiles. Entrant will also be asked to consent to receive email for the purpose of updates throughout the contest. Applicant will then be asked a series of questions about their creative background. Answering survey questions is optional and does not have to be agreed to in order to be eligible to enter the Contest or to win a prize. Entrants are responsible for insuring that all contact information is up-to-date and accurate. Sponsor is not liable for any disputes between collaborators arising under or related to the Contest. Employees of Hype Hustle, their affiliates, subsidiaries, advertising and promotion agencies, agents, and the immediate family members and/or those living in the same household of each are not eligible to participate in the Contest in any manner except as otherwise expressly provided herein (e.g., as non-Entrant individuals judging Entries during specific stages of the Contest) or to win any prize. Misrepresentation of age, upon discovery by Sponsor will disqualify the applicable Entrant(s). Sponsor reserves the right, at any time and in its sole discretion, to refuse to allow any individual to participate or continue to participate in the Contest, or to disqualify any individual it suspects to be tampering with the entry process or the operation of the Contest or the Website, to be in violation of any terms and conditions governing the use of the Website (“Terms of Use”) or any privacy policy governing the submission of information through the Website (“Privacy Policy”); to be in violation of these Official Rules; to be acting in bad faith, or in a non-sportsmanlike or disruptive manner; or to be annoying, abusing, threatening, or harassing any other person.  The Hype Hustle reserves the right to not accept any application which is not considered visually unacceptable for the website.  ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF THESE OFFICIAL RULES AS WELL AS CRIMINAL AND CIVIL LAWS.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO, DISQUALIFY THE ENTRANT AND SEEK REMEDIES AND DAMAGES FROM ANY RESPONSIBLE PARTICIPANT(S) TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING, WITHOUT LIMITATION, CRIMINAL PROSECUTION.

Contest Description: The Hype Hustle Contest (the “Contest”) is a skill based contest in which Entrants will showcase creative and online marketing abilities and will compete by submitting music, pictures, and videos for a profile, which may then be marketed to music fans.  For the duration of the contest, the content submitted is exclusive to Hype Hustle with no mechanical assistance and with accompanying music approved or to be of original authorship. Entrants will compete with the end goal to win recording sessions, music videos, and photo shoots, as well as to have their profile featured permanently featured on the website, should it exist.  Prizes are subject to change at the discretion of the sponsor.  Resonate Studios, Aristocrass Studio, and Ambushe prizes are subject to availability.  Additional prizes may be made available by The Hype Hustle and it’s affiliates.  It is the responsibility of winners to claim prizes in Los Angeles, CA.  Each Application submitted by an eligible Entrant will be judged by the system of HHP used for the Hype Hustle (as further described below).

HHP Opportunities

Random Twitter Challenges  – 100 HHP each
Twitter challenges must be completed on the day they are released.  Rules for each Twitter challenge are disclosed upon release.  Twitter challenges are released randomly on the Official Hype Hustle Twitter account.  The number of Twitter Challenges released is at the discretion of the Hype Hustle competition but is limited to 1 per day.

HustlEveryDay Award may be given to any applicant at the sole discretion of Elliot Van Nest.  Past Winner Award may be given to any applicant at the sole discretion of the last winner of the Hype Hustle Competition for that respective category of creatives.  The Guest Judge Award may be given to any applicant at the sole discretion of the Guest Judge for the competition.  If the past winner or guest judge is unable or unwilling to pick a winner on the final day of the competition, the award may be given to any applicant at the sole discretion of the President of the Hype Hustle competition.

Contest Start and End Times:  The contest begins on March 1, 2012 (“Start Date”) and ends on March 31, 2011 (“End Date”) (“Contest Period”).  The Contest will run for this one-month period and applications may be submitted any time in the prior month of February.  The Hype Hustle reserves the right to delay competitions, as many times as necessary, by one month intervals, to include more applicants in the competition.  The Hype Hustle reserves the right to delay an application until the following competition. Registered Applicants will then receive HHP or Hype Hustle Points for various challenges including but not limited to voting polls, profile traffic, and twitter challenges.  Registered Applicants may also receive HHP from appointed judges at the discretion of the contest. The Contest Winner who has the highest number of HHP shall be declared the Grand Prize Winner of the Contest (“Grand Prize Winner”), subject to verification and compliance with these Official Rules.

To Enter: Once you have completed your application during the month of February for the contest beginning and ending in March, you can earn HHP, or Hype Hustle Points, for various tasks and challenges listed on the website, under the HHP page. First, second, and third place prize winners will be featured on the site. Only one (1) artist per profile is permitted. If an artists profile is selected as one of the winners, then the artist may NOT Re-Enter the Contest. However, if artist is not selected as a winner, he/she may submit an application into any future competition, until and if they become a winner.  If an Entrant who is not chosen as a Winner chooses, he/she may re-submit the same application, with or without improvements, new clips and content in a later competition.  If an applicant is not chosen as a Winner, he/she are free to put it on their blog, sponsor site, hold out for next round of competition or do with it as they see fit.  Any applicant may request that a profile featuring him/her be removed from the site at any time, at which point, that profile becomes automatically disqualified.  Profiles must be submitted no later than the respective Submission Deadlines to which they are submitting an application. Entrants attempting to create a profile will be required to agree to Contest Terms and Conditions of Submission and these Official Rules.  By submitting an application, each Entrant expressly accepts and, to be eligible for the Grand Prize, must comply with, the Contest Terms and Conditions of Submission, which are set forth below and are expressly incorporated herein. Entrants must read the Contest Terms and Conditions of Submission carefully and accept them prior to uploading a profile. Please read them prior to creating a profile for submission into the Contest. In the event that a profile does not comply with any of the terms of these Official Rules (including the Contest Terms and Conditions of Submission), such profile entry may be void at Sponsor’s discretion.  Sponsor reserves the right to refuse any application on any grounds.

Each profile: (a) must be a wholly original, audio-visual performance created by the Entrant based on the Authorized Contest Materials using authorized music or obtaining clearances for music used; (b) must be intended for family audience viewing and contain only content that, in the sole discretion of the Sponsor, is suitable for all persons over the age of 13; (e) must not, in the sole discretion of the Sponsor, contain or involve any of the following: (i) obscenity, (ii) private property, or other property (unless Entrant has obtained a signed property release specific for the uses specified herein), (iii) crude, vulgar or offensive pictures, depictions, images, language and/or symbols, (iv) gang signs or symbols, (v) nudity, (vi) license plates, phone numbers, personal addresses (physical, email or otherwise), (vii) derogatory characterizations of any ethnic, racial, sexual or religious groups, (vii) content that humiliates one or more persons (publicly or otherwise), (ix) content that assaults or threatens others, (x) trespass or the violation of other people’s rights or property; (xi) illegal (e.g., discriminatory, harassing) or inappropriate activity, behavior or conduct (e.g., inflicting emotional distress), (xii) conduct or activities in violation of these Official Rules, or (xiii) any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable or offensive, as determined by the Sponsor in its sole discretion; (f) must not contain content which endorses or condones illegal drug use or alcohol abuse and narcotic addiction; (g) must not contain any sexually explicit content; (h) must not contain violence; and (i) must not contain any copyrighted works for which the necessary rights have not been obtained (excluding the Authorized Contest Materials) or any other information, content or materials that infringe the rights of any third party or violate any applicable laws or regulations; (j) cannot have been previously submitted or won any awards in any other competition; (k) must not be degrading of the Contest, as determined by the Sponsor in its sole discretion; and (l) must not be deemed low-quality production, as determined by Sponsor in its sole discretion.

All elements used, incorporated into or otherwise appearing in a profile including, without limitation, audio, speech/voiceovers, stills, video, supers or any other audio-visual materials (collectively, “Elements”) must be performed by the artist or Entrant, and must be cleared by the Entrant.

Sections not meeting all entry requirements stated herein will be disqualified.

Selection of Winners/Grand Prize Winner: Once the competition is over, the three (3) Winners will be featured on the Hype Hustle website.

Judging Criteria/Winner Notification: All profiles submitted will be judged by the Guest Judge, appointed at the sole discretion of the Sponsor, as well as the Past Hype Hustle Winner, acting as a judge, and Elliot Van Nest, acting as a judge, in the judge’s own sole discretion.  The decisions of the Judges are final and cannot be appealed. Sponsor may, in its sole discretion, contact each Winner and require any such Winner to answer additional questions or participate in additional screening procedures; require such Winner and all individuals appearing in such Winner’s Entry to sign consent forms and/or releases; and or disqualify any Winner who is unable or unwilling to do or provide any of the foregoing.  Without limiting the foregoing, each Winner who is under 18 years of age or is a minor in his or her state of residence will be required to have his or her parent or legal guardian affirm in writing such Winner’s acknowledgment and agreement to the Official Rules and Submission Agreement, in order to continue to participate in the Contest. In the event that any Winner or the applicant elects to end his or her participation in the Contest, is unable to participate further in the Contest for any reason, or is, in Sponsor’s discretion, deemed to be ineligible to participate, Sponsor reserves the right to replace Winner with an alternate Winner Entrant. When all Winners have been finally determined, Sponsor will announce the Winners and the Grand Prize Winner on the Contest Website, and may announce the Winners and Grand Prize Winner on certain Sponsor-affiliated sites or services. Notification of Grand Prize Winner must be kept confidential until the Grand Prize Winner is publicly revealed by the Sponsor. The Sponsor reserves the right to select fewer than three (3) Winners in the event that there is an insufficient number of Sections that are deemed to meet the applicable criteria or if any potential Winner, in the sole opinion of the Sponsor, does not comply with the Sponsor’s eligibility and verification requirements.

Prizes:
1st Place – 1st Place prize winners will be provided one (1) four hour (4 hr) recording session at Aristocrass or Resonate Studios, one (1) music video, and one (1) photo shoot.  Day to claim prize is at the discretion and availability of The Hype Hustle.  The Hype Hustle reserves the right to refuse service to any winner who refuses to respect the professional atmosphere the studio, production company, or website maintains.  The Hype Hustle may use photography and video from recording session, photo and video shoots in any way shape or form for an unlimited amount of time, for any promotional purposes.
2nd Place – 2nd Place prize winners will be provided with one (1) music video, and one (1) photo shoot.  Day to claim prize is at the discretion and availability of The Hype Hustle.  The Hype Hustle reserves the right to refuse service to any winner who refuses to respect the professional atmosphere the production company or website maintains.  The Hype Hustle may use photography and video from recording session, photo and video shoots in any way shape or form for an unlimited amount of time, for any promotional purposes.
3rd Place – 3rd Place prize winners will be provided with one (1) photo shoot.  Day to claim prize is at the discretion and availability of The Hype Hustle.  The Hype Hustle reserves the right to refuse service to any winner who refuses to respect the professional atmosphere the website maintains.  The Hype Hustle may use photography and video from recording session, photo and video shoots in any way shape or form for an unlimited amount of time, for any promotional purposes.

Prize Restrictions: ALL COSTS, INCLUDING FEDERAL, STATE AND LOCAL TAXES AND OTHER EXPENSES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. The Hype Hustle is not responsible for transportation or lodging for winners of the competition.  Winners who cannot claim their prizes, in Los Angeles, CA, for any reason(s) will still be featured on the home page of the Hype Hustle website for the duration of the next competition, but waive their right to participate in coordinated photo and music video shoots.  The Hype Hustle reserves the right to select alternative winners in scenarios when winners cannot make it to Los Angeles, CA.

Entry Details: The name of the “authorized account holder” associated with any given email address will be deemed to be the Entrant and must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, an online service provider, or another organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Proof (to Sponsor’s satisfaction) of being the authorized account holder may be required by Sponsor. Sponsor is not responsible for: lost, incomplete, late, damaged, or misdirected entries, email messages; failures or malfunctions of phones, phone lines or telephone systems or other communications malfunctions; interrupted or unavailable network, server or other connections including those through www.hypehustle.com; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation in this Contest; printing or other errors appearing within these Official Rules or in any Contest-related advertisements or other materials; other errors or problems of any kind whether mechanical, human, technical, electronic or otherwise; or the processing or judging of entries or Trailers. The use of automated entry or similar devices, as specifically set forth above, is prohibited and entries through such prohibited devices are void. By entering this Contest, Entrants give their express permission to be contacted by Sponsor by telephone, email and/or postal mail for Contest purposes only.

Miscellaneous: No transfer, assignment, cash redemption or substitution of prizes (or portion of prize) is allowed except by Sponsor due to prize unavailability and then only for a prize (or applicable portion of prize) as determined by Sponsor. If any prize notification letter or prize is returned as undeliverable, winner will be disqualified and an alternate winner may be selected. By participating, each Entrant acknowledged and agrees: (1) to be bound by these Official Rules (and the Contest Terms and Conditions of Submission, as applicable) and the decisions of the Sponsor and judges which are final and binding in all respects; (2) that Profiles (and all components thereof) will not be acknowledged; (3) that Sponsor and its designees shall have the right and permission to use (unless prohibited by law) Entrant’s name, voice, city and state of residence, photograph and/or likeness for advertising and/or trade and/or any other purpose in any media now or hereafter known without further compensation, permission or notification to Entrants or any third parties; and (4) the Sponsor shall have no liability and will be held harmless by Entrants for any liability, loss, injury or damage to participants or any other person or entity, including personal injury or death to participants or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of Entrant’s participation in this Contest, the use of any Profile or acceptance, possession, use or misuse of a prize. Sponsor reserves the right, in its sole discretion, to void suspect profile or to modify, cancel, terminate or suspend the Contest (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, including but not limited to war or armed conflict (whether or not officially declared), labor controversy or threat thereof, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of the Contest and, in the event of such cancellation, suspension or termination, at its discretion, as applicable, select profile from among all non-suspect, eligible profile received prior to event requiring cancellation, termination or suspension.

Email Change of Address Policy: It is the sole responsibility of the Entrant to notify Sponsor if his or her email address changes. To do so, visit www.hypehustle.com.

Disputes/Choice of Law: Except where prohibited, each Entrant agrees that: (i) all issues and questions concerning these Official Rules shall be governed by California law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Contest or any prize awarded shall be (A) resolved individually, without resort to any form of class action, and (B) filed only in the state or federal courts situated in Los Angeles County, California, and Entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (iv) under no circumstances will any Entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

Privacy: Personally identifiable information that is submitted by Entrants as part of this Contest will be used to administer the Contest, select prize winners and fulfill prizes.  Entrants acknowledge and agree that their name, image, social media links, and personal information may be used by the Hype Hustle indefinitely for any promotional purposes.
